Article 1 - Purpose
These General Terms and Conditions of Use and Sale (hereinafter the “T&Cs;”) are intended to determine, on the one hand, the terms of access to and use of the website parts24.ma and, on the other hand, the contractual conditions governing any sale of products carried out through said site. Use of the site and the placement of any order implies full and complete acceptance of these T&Cs;, which prevail over any other document, unless otherwise expressly agreed in writing.
Article 2 - Definitions
For the purposes of these T&Cs;, the following terms shall have the meaning set out below:
- • Publisher: AUTO OCCASIONS MAROC, operating the website parts24.ma, registered with the Casablanca Trade Register under number 578207.
- • User: any natural or legal person accessing the website, whether as a simple visitor or as a customer.
- • Customer: a user who has placed an order via the website.
- • Account: a personal, secure space allowing the user to access specific services of the platform.
- • Marketplace: a virtual space allowing third-party sellers to offer their products for sale via the website.
Article 3 - Access to the site
Access to the site is open to the public, free of charge, except for Internet connection costs. The site is in principle accessible continuously, except for interruptions required for maintenance, updates, or in the event of force majeure. The Publisher cannot be held liable for interruptions or malfunctions attributable to external factors.
Article 4 - Creation and management of the user account
Creating an account requires providing accurate, complete, and regularly updated information. The User remains solely responsible for the confidentiality of their identifiers and passwords, as well as for any use of their Account, whether authorized or not. The Publisher reserves the right to suspend or delete any account in case of non-compliance with these T&Cs; or proven fraud.
Article 5 - Products and services
The products sold on the site are subject to a detailed description presenting their essential characteristics. Photographs and illustrations are provided for information purposes only and shall not bind the Publisher. Product availability is indicated at the time of ordering, subject to stock errors or unavailability.
Article 6 - Orders
An order is deemed firm and final once validated by payment from the Customer. A confirmation email specifying the essential elements of the order is sent to the Customer. It is the Customer’s responsibility to check the compatibility of the parts ordered with their vehicle. The Publisher cannot be held liable for a selection error attributable to the Customer.
Article 7 - Prices and payment terms
Prices are indicated in Moroccan Dirham (MAD), inclusive of all taxes. Delivery costs and, where applicable, additional duties or taxes are communicated prior to final order validation. Accepted payment methods include, among others, bank card, bank transfer, and cash on delivery when this option is available. Electronic transactions are secured through the Interbank Electronic Payment Center (CMI) platform.
Article 8 - Delivery and transfer of risks
Delivery times are provided for information purposes only and may vary depending on the destination. Risks are transferred to the Customer once the Publisher hands over the purchased products to the transport and delivery company. The Customer must check the condition of the package and notify any specific reservations to the transport and delivery company within 48 hours. The Publisher’s liability cannot be engaged for damages, losses, or deterioration affecting the Products after their handover to the carrier, as this handover constitutes transfer of risk to the Customer
Article 9 - Right of withdrawal
In accordance with the provisions of Law No. 31-08 on consumer protection, the Customer has a period of seven (7) working days from receipt of the product to exercise their right of withdrawal, without penalty and without justification. Excluded from this right are:
- • customized or specific products,
- • products that have been assembled, installed, or used,
- • unsealed products that cannot be returned for hygiene or safety reasons.
Article 10 - Warranties
The products benefit from:
- • the statutory warranty of conformity,
- • the statutory warranty against hidden defects.
Any warranty claim must be made in writing and accompanied by the necessary supporting documents.
Article 11 - Customer service and complaints
Customer service can be reached at the contact details indicated on the site. Any complaint must be submitted in writing and accompanied by relevant supporting documents. The Publisher undertakes to process complaints within a reasonable timeframe.
Article 12 - Liability
The Publisher’s liability is strictly limited to the obligations incumbent upon it under these T&Cs.; When the sale is carried out by a third-party seller via the Marketplace, the latter remains solely responsible for contract performance and product compliance. The Publisher cannot be held liable for damages resulting from improper installation, inappropriate use, or assembly carried out by the Customer. In any case, the Publisher’s liability is limited to the total amount of the disputed order.
Article 13 - Force majeure
The occurrence of an event constituting force majeure, as defined by the Morocco Code of Obligations and Contracts, exempts the Publisher from all liability and justifies suspension or cancellation of contractual obligations. Events considered as force majeure include, in particular: strikes, health crises, natural disasters, transport disruptions, or any external event beyond the Publisher’s reasonable control.
Article 14 - Personal data and cookies
Data collected through use of the site is processed in accordance with the provisions of Law No. 09-08 on the protection of personal data. The Publisher undertakes to complete the necessary formalities with the National Commission for the Control of the Protection of Personal Data (CNDP). The User has a right to access, rectify, and delete their personal data. Use of the site implies acceptance of the cookies necessary for its proper functioning and for the improvement of its services.
Article 15 - Intellectual property
All elements comprising the site (texts, trademarks, logos, databases, images, videos, software) are protected under Morocco intellectual and industrial property law. Any reproduction, representation, or exploitation, in whole or in part, without prior written authorization, is strictly prohibited.
Article 16 - Suspension and termination of the account
In the event of non-compliance with these T&Cs;, or in the case of proven fraud, the Publisher reserves the right to suspend or terminate the User’s account, without prejudice to any legal action that may be taken.
Article 17 - Modification of the T&Cs;
The Publisher reserves the right to modify these T&Cs; at any time. The applicable conditions are those in force at the date of use of the site or of placing the order.
Article 18 - Governing law and jurisdiction
These T&Cs; are governed by Morocco law. Any dispute relating to their interpretation, validity, or execution falls under the exclusive jurisdiction of the courts of Casablanca.
Article 19 - Exchanges and Refunds
Subject to the provisions of Article 9 relating to the right of withdrawal, the Customer has a period of seven (7) working days from the date of receipt of the product to request an exchange or refund, provided that all of the conditions below are strictly met.
1. General Conditions
- • All requests must be submitted in writing to the Parts24.ma customer service team, accompanied by the purchase invoice and clear photos of the received product.
- • No return will be accepted without prior written approval from customer service.
- • The product must be returned in its original condition and packaging, complete (including accessories, instructions, and labels), unused, uninstalled, and undamaged.
- • Return and reshipment costs are borne by the Customer, except in cases of proven error attributable to the Publisher (wrong reference, incorrect item, or verified defect upon delivery).
2. Exchanges
An exchange may only be accepted in the following situations:
- • wrong reference confirmed by Parts24.ma,
- • visible defect reported within 48 hours of delivery,
- • clear non-conformity between the delivered product and the description validated at the time of order.
The exchange is subject to product availability in stock. If the replacement item is no longer available, the Customer may choose to:
- • receive another product of equivalent value, or
- • request a partial or full refund under the conditions below.
3. Refunds
When the return is approved by customer service, the refund will be processed within a maximum of fourteen (14) working days from the date of receipt and verification of the returned product.
Refunds will be made using the same payment method used for the original order, unless the Customer expressly agrees otherwise. Delivery, return, and handling fees are non-refundable, except where the fault lies with Parts24.ma.
4. Exclusions
No exchange or refund shall be granted if:
- • the product has been installed, mounted, tested, or used, even briefly,
- • the product shows signs of wear, improper installation, or handling,
- • the original packaging is damaged, missing, or repackaged,
- • the product is custom-made, specific, or personalized,
- • the request is submitted after the seven (7)-day period.
5. Products Under Warranty
When a product is covered by a manufacturer’s or partner’s warranty, any related claims shall be handled directly under the terms of that warranty, in accordance with the manufacturer’s or third-party seller’s conditions.
Parts24.ma shall not be held liable for any refusal of warranty coverage by the manufacturer.
